			<content:encoded><![CDATA[<p>The main focus of industry interest as the week ends was Thursday&#8217;s Kentucky Supreme Court hearing on whether the state government has the jurisdiction to seize 141 international domain names owned by online gambling companies based beyond the reach of Kentucky enforcement.</p>
<p>The appearance of lawyers to give oral arguments backing up previous submissions to the court is the latest in a series of legal clashes following the state&#8217;s notorious attempt last year to seize and confiscate the domains. </p>
<p>The case has to date been aired in a district Kentucky court, before a panel of three judges in the Kentucky Court of Appeals and now before the Kentucky Supreme Court as Governor Steve Beshear&#8217;s outsourced lawyers attempt to reverse court decisions that have consistently gone against them.</p>
<p>Opposing the government&#8217;s appeal was the Interactive Media Entertainment and Gaming Association, Inc., and the Interactive Gaming Council, two trade associations that have consistently opposed the state&#8217;s assault on the freedom of the internet and the owneship rights to domain names.</p>
<p>In his address to the court on Thursday, Eric Lycan, a private attorney representing the Kentucky Justice Cabinet argued: &#8220;They [the domain owners] have been using these [domains] to violate the law in Kentucky. They are subject to forfeiture.&#8221;</p>
<p>Attorneys for the state maintain that gambling over the Internet is illegal, and that the state has the authority to stop it from taking place within Kentucky&#8217;s borders. They say the companies &#8212; no matter where they&#8217;re based &#8211; should either block Kentucky residents&#8217; access or face seizure from the state. And they claim that the domain names can be defined as &#8220;gambling devices&#8221; in terms of Kentucky law.</p>
<p>But, reports Associated Press, the attorneys representing the domain owners disagree, arguing that online gambling isn&#8217;t illegal in the state because the Kentucky General Assembly has not taken any specific action to declare it unlawful. Furthermore, the state doesn&#8217;t have jurisdiction over companies outside the state and domain names cannot be described as gambling machines or devices. </p>
<p>Attorney Bill Johnson, representing some of the domain owners, argued that the state has improperly mixed civil and criminal elements in the case.</p>
<p>&#8220;The ultimate issue in this case is whether a domain name is a gambling device under the statute,&#8221; Johnson told the court. &#8220;This case should have never proceeded in the beginning.&#8221;</p>
<p>Attorney Jon L. Fleischaker, who represented iMEGA, said state lawmakers have had the opportunity to make online gambling illegal and have not. Fleischaker also said his clients have not had the benefit of proper due process.</p>
<p>&#8220;It is mind-boggling,&#8221; Fleischaker told the court.</p>
<p>A ruling from the court is now awaited, and could take weeks or even months.</p>
<p>With the completion of the oral arguments, the Poker Players Alliance &#8211; a players association with over a million members &#8211; issued a statement on the issue.</p>
<p>&#8220;I am very pleased with the arguments presented today supporting the Kentucky Court of Appeals ruling prohibiting the Commonwealth&#8217;s seizure of these domain names and I strongly believe we will prevail,&#8221; said executive director John Pappas. &#8220;This case is about more than playing poker online – it&#8217;s about protecting Internet freedom and the individual rights of Kentucky residents. </p>
<p>&#8220;If the Commonwealth is truly interested in protecting consumers, it should put its energy in licensing and regulating online poker – which would also bring in millions in revenue – versus attempting to banish online poker through such a bold, broad and unlawful seizure.</p>
<p>&#8220;The PPA looks forward to a positive ruling from the Kentucky Supreme Court and hopes to work with lawmakers in the Commonwealth on the common sense solution of licensing and regulation.&#8221;</p>

<p>Researchers at the University of Adelaide surveyed 2669 teenagers aged between 13 and 17, and found 56 per cent had gambled in the past year. They also found 2.4 per cent became pathological gamblers by the time they were 18.</p>
<p>That was higher than the 2.1 per cent of adults found to be problem gamblers by the Productivity Commission in 1999, although the level of harm &#8211; such as losing a house or a relationship &#8211; was much lower for adolescents.</p>
<p>The paper, to be published in the Journal of Gambling Studies next month, found that teenage problem gamblers played arcade games three times more often than non-gamblers, and on average they played hand-held games and internet games more than twice as often.</p>
<p>One of its authors, Associate Professor Paul Delfabbro, said teenage boys were more likely to play video games and gamble regularly, which was one reason for the correlation.</p>
<p>&#8221;The other reason is that the sorts of kids who are playing video games probably do so because they&#8217;ve got less parental supervision,&#8221; he said. &#8221;They&#8217;re probably bored; they probably don&#8217;t have a lot of structured activity in their life.</p>
<p>&#8221;So the physical act of playing video games doesn&#8217;t increase the risk of gambling but it is indicative of a pattern of leisure activity, which probably means you&#8217;re going to find gambling an entertaining activity.&#8221;</p>
<p>Associate Professor Delfabbro said the levels of internet gambling and access to poker machines among adolescents had been kept relatively low compared with Britain and the US.</p>
<p>But a high proportion of teenagers who played video games went on to take part in some form of gambling, most commonly buying scratchies, playing card games, and playing poker machines.</p>
<p>A separate study by Associate Professor Delfabbro found that children who had gambled on a poker machine by the age of 16 were four times more likely to be regular gamblers by 19.</p>
<p>&#8221;They&#8217;re putting money on private card games, they&#8217;re betting on sporting events, they buy scratch tickets from newsagents,&#8221; he said.</p>
<p>Dean Bryden, 22, said he began gambling at 14 and soon developed a habit of playing card games at home and on the internet.</p>
<p>His habit increased until he spent $180,000 in a single year, mainly playing blackjack and poker.</p>
<p>&#8221;It&#8217;s an adrenaline rush for people,&#8221; he said. &#8221;I think the internet poker is a big thing because you don&#8217;t have to be over the age of 18; it doesn&#8217;t matter how old you are.</p>
<p>&#8221;You start off having some fun with your mates online and you end up at the casinos spending money.&#8221;</p>
<p>Liem Dang, 19, of Canterbury, has been playing video games since he was 12 and is also a gambler.</p>
<p>He said he saw the correlation between the two, as each could be social and competitive.</p>
<p>&#8221;I agree with the study,&#8221; he said. &#8221;I game for the social aspect and to put my abilities up against someone else and for gambling that happens as well. The sense of humiliation involved is also the same.&#8221;</p>
<p>Despite spending much of his time playing online games, he preferred not to gamble over the web and only used Facebook poker. &#8221;I go to Star City around once a month. I would rather spend my money in the real world, I guess.&#8221;</p>

			<content:encoded><![CDATA[<p>The Seneca Gaming Corp. reported a quarterly loss of $82.7 million in its latest filing with the Securities and Exchange Commission, the first quarterly loss since the gambling operation began in 2002, when it opened its first casino in Niagara Falls.</p>
<p>Corporation officials blamed most of the loss on a write-off of $109 million in stalled construction projects, including the long-delayed Buffalo Creek Casino and Hotel and suspended improvements</p>
<p>to gambling facilities in Niagara Falls and Salamanca.</p>
<p>In addition, gambling revenue declined $15.5 million in the three months ending June 30 when compared with the same time last year, a drop of 10 percent. Gambling revenues dropped $12.6 million, or 12 percent, at the Seneca Niagara Casino and Hotel, and they declined another $4.5 million, or 11 percent, at the Seneca Allegany Casino and Hotel, the report noted.</p>
<p>The one bright spot was a $1.6 million increase, or an 18 percent spike, in gambling revenues at Seneca Buffalo Creek.</p>
<p>To capitalize on that, the report notes that the Seneca Nation of Indians offered earlier this month to loan $9 million to Seneca Gaming. The loan would be used to expand the temporary casino to add another 250 slot machines to the 244 machines already on line.</p>
<p>Seneca Gaming has not yet accepted the loan offer, made at a 5 percent interest rate.</p>
<p>The gambling operation has drastically cut costs since the economy started siphoning off its steady flow of customers, part of a nationwide slump in gambling revenues.</p>
<p>The Seneca casinos earlier cut their work force by 5 percent, froze executive salaries and reduced the amount of money paid to the Seneca Nation in the form of head leases for the casino properties.</p>
<p>But it was the $109 million write-off that did the most damage to the gambling operation’s bottom line in this quarter.</p>
<p>Catherine Walker, Seneca Gaming’s chief operating officer, did not return a telephone call to comment on the report.</p>
<p>But a corporation lawyer, James Domzalski, confirmed the operating income loss and said the majority of that was because of the write-off. He said corporation officials would have more details in a call with financial analysts.</p>
<p>The report noted that on Aug. 27, 2008, construction was suspended at Seneca Allegany Casino and Hotel, as well as the Seneca Buffalo Creek Casino and hotel. Officials cited the recession, unfavorable interest rates for expansion and demands on casino cash, including payments to the Seneca Nation.</p>
<p>Planning efforts on adding to the Niagara Falls Casino and Hotel also were suspended at the same time.</p>
<p>Seneca Gaming wrote off $87 million for the Buffalo operation, $18 million for Salamanca and $3.5 million for Niagara Falls.</p>
<p>The gambling operation, owned by the Seneca Nation, said it has had recent discussions with nation officials to further reduce the amount of money Seneca Gaming provides to the Senecas.</p>
<p>The tribal council withdrew an earlier request for $20 million for capital improvements, and the monthly payments to the nation were reduced in March from $4 million to $3 million. Another $5 million given to the nation for capital improvements was returned, and there is a $5 million reduction in rent for the three casinos.</p>
<p>The SEC report also noted that the Seneca Gaming Authority, the self-regulating arm of the casino operations, has recommended fines of $1 million for Seneca Gaming and another $8 million in fines to 11 of its employees.</p>
<p>The authority issued notices of violation for an infraction on April 3, when $25,971 in gambling chips were left on a table and were then mixed in with chips from other tables.</p>
<p>Seneca Gaming is contesting the charges and said there was no net revenue lost, a claim it said was backed up by its auditors, PricewaterhouseCoopers. </p>

And we&#8217;re sure eCogra will continue to endorse those groups.  J. Todd of Perspectives Weekly continues to blast Grand Prive.  But he&#8217;s only one man.  Next month the new and improved CAP Euro is hosting an event in Budapest expected to receive a substantial turnout.  We can only hope that online casino affiliates discuss this situation and realize the ramifications should they allow eCogra to continue promoting this Microgaming online casino group.   Todd has already expressed what is about to happen.  A handful of online casino affiliates are looking to change their terms just as Grand Prive has.  They realize that the affiliate community is not making enough of an uproar to hurt their business.   Andrew Beveridge of eCogra did speak to CasinoMeister.com about his position on Grand Prive, which, anyone with half a brain would find unacceptable.  &#8220;Our eGAP standards applicable to casinos don&#8217;t provide any assurances in relation to the fair treatment of affiliates,&#8221; Beveridge explained. &#8220;This seal is clearly intended to convey only to players where they will be protected.     &#8220;Equally, if it were alleged that Grand Prive hadn&#8217;t paid their advertising agency&#8217;s fees, or any other third party creditor not covered by the eGAP standards, their casinos would not lose their Safe &amp; Fair seals.&#8221;  Unfortunately this situation goes well beyond a simple advertising dispute.  Grand Prive is not dropping certain affiliate partners for &#8220;lack of performance&#8221; or &#8220;violation of terms&#8221; &#8211; something we might be able to live with.  Grand Prive is dropping ALL their supposed &#8220;life long affiliates&#8221; without explanation.  That&#8217;s called &#8220;unethical&#8221; and it is very easy to see in this scenario how GP management could do the same to players.  The question asked by Casino Meister:  Considering how unethical it is for the GP affiliate program to treat its business partners in this matter, what assurances does the player have that the casino side of the business will treat its players any better?  The response from Beveridge, an obvious knock at CAP:  &#8220;I have had various discussions with Grand Prive&#8217;s management to understand what transpired with their affiliate program, and I don&#8217;t believe all the facts are properly understood by the affiliate community.  &#8220;I am of the opinion that Grand Prive would have been judged less harshly if a certain ‘watchdog&#8217; in the affiliate community had taken advantage of Grand Prive&#8217;s offer to explain their side of the story.  &#8220;We have had a 6 year relationship with Grand Prive, because this was one of the very first operators to apply for our seal in 2003. As with most of the eCOGRA operators that have been awarded the seal for so many years, there have been incidents where we&#8217;ve had to work with this operator to address player disputes. However, based on their ongoing maintenance of the eCOGRA standards, we have no reason to believe that the players are at risk.&#8221;  Of course he failed to respond to the question, which was WHY GRAND PRIVE DECIDED TO SCREW ITS ONLINE CASINO AFFILIATES.  Instead we get to hear about his terrific relationship with these folks.   &#8220;We haven&#8217;t investigated this incident fully because it is not part of our mandate,&#8221; Beveridge added.</p>
